The end of the 2024 Minnesota legislative session saw many changes to the state’s employment laws, including Minnesota Statutes Section 181.173.
Effective January 1, 2025, Minnesota’s new law requires employers that employ 30 or more employees at one or more sites in Minnesota to post the starting salary range or fixed pay rate. A general description of all benefits and other compensation to be offered to a selected job applicant is also required.
A covered employer must disclose a starting salary range showing a minimum and a maximum or fixed hourly rate of pay. The ad, whether posted electronically or in print, that outlines the qualifications for prospective applicants and is intended to recruit candidates for a specific position, is required to include wage information. This requirement applies regardless of whether you, as the employer, are recruiting directly or through a third party.
Additionally, benefits and other compensation to be offered to a hired job applicant must also be listed. At a minimum, you should include any health benefits, retirement benefits, and other financial perks associated with the position.
The Department of Labor and Industry or the Minnesota Attorney General may enforce violations of this law, which does not specify penalties for noncompliance.
